The Rochester-based Unshackle Upstate, a pro-business lobbying coalition, gave high marks to predominantly Senate Republicans in their legislative report card released this morning, but Sen. Malcolm Smith, D-Queens, also scored well when it came to backing business-friendly measures.

Smith, a potential 2013 mayoral candidate for New York City on the Republican line, was the highest scoring Senate Democrat with a 77 percent rating from the group, out ranking two Senate GOP lawmakers: Sens. Greg Ball of the Hudson Valley and Marty Golden of Brooklyn.

In seeking the GOP line for mayor, Smith has sought to play up his relatively moderate stances in the minority conference.

The highest ranking senators in the report card were Sens. Charles Fuschillo, Pat Gallivan and Michael Nozzolio, all who received a 94 percent grade.

At the bottom: Sens. Tom Duane and Ruben Diaz, two New York City Democrats who clearly do not see eye-to-eye on social issues, but have agreed when it comes to measures aimed at benefiting the poor (both were in the basement of the Business Council rankings as well).

Unshackle based its rankings on the budget bills, sponsorship of bills backed or opposed by Unshackle.

The report card focused on whether lawmakers backed measures like the 2 percent limit on property tax increases and the Tier Six pension overhaul, both of which passed in 2011 and 2012 respectively.

The group says overall legislators’ grades have “improved” from the last election cycle in 2010.

“These scorecards provide a clear picture of which Senators and Assembly members are working to promote job growth and strengthen our economy,” said Unshackle Executive Director Brian Sampson. “Our hope is that hard-working taxpayers and employers will see their legislators’ grades and start a discussion with their network of friends, family and colleagues.”

In the Democratic-led Assembly, three Republicans scored 100 percent ratings: Michael Fitzpatrick, Stephen Hawley and Kevin Smardz. Assemblyman Robin Schimminger of Kenmore, generally considered the most conservative Democrat, received a 100 percent rating.

Assemblywoman Inez Barron of Brooklyn, received a negative six rating.
