As The Times Union first reported today, lawyers for former Senate Majority Leader Joe Bruno filed a slew of documents in federal court seeking to dismiss the second indictment of public corruption charges calling the new case “fatally flawed.”

Bruno’s lawyers argue for dismissal on several technical points, including the expiration of the statute of limitations before a superseding indictment was filed and that the government’s theory of the case has evolved during the saga.

Federal prosecutors have a month to respond.

Bruno, an 83-year-old Republican from Rennselaer County, was convicted of theft of honest services charges, but that was later overturned by a federal court following a U.S. Supreme Court ruling on the charge.
